SHORT TITLE:
Administration, state owned vehicles

ABSTRACT OF INTRODUCED BILL: The purpose of this bill is to authorize the legislative rule of the Department of Administration relating to state owned vehicles. It amends a current legislative rule as follows:

  1. § 2 adds and revises definitions of terms used through-out the rule series;


  1. § 3 requires each agency to appoint a fleet coordinator;


  1. § 6 clarifies that only state employees may be passengers in state-owned vehicles without specific written approval;


  1. § 8.1 makes the operator of a state-owned vehicle personally responsible for citations, warrants or fines resulting from the operation or parking of the state-owned vehicle;


  1. § 8.3 requires the use of safety belts while in operation;


  1. § 8.5 prohibits the use of wireless communication devices except when used hands-free, with exceptions for emergencies;


  1. § 8.6 removes the requirement that the Travel Management Office monitor the driving records of operators, and removes the Accidents and Violations Review Committee;


  1. § 9.2 requires vehicles to be kept on state property when not in use;


  1. § 9.3.2 prohibits the use of vehicles for personal use unless the personal use is de minimis;


  1. § 9.4 requires commuting value, payroll deductions and reimbursements to be calculated in accordance with IRS rules;


  1. § 9.5 removes provisions related to the use of privately owned vehicles, as this topic is covered in the State Travel Rules;


  1. § 10.1 requires approval of Travel Management Office prior to the purchase of a vehicle;


  1. § 10.2 requires reimbursement to the Travel Management Office for administrative costs of authorizing spending units to lease or purchase vehicles from entities other than the Travel Management Office;


  1. § 10.5 removes log requirement as the logs are the responsibility of each spending unit;


  1. § 10.6 requires purchase of automotive commodities and services be made from the state- wide contract;


  1. § 10.10 requires the Travel Management Office to issue regular invoices to spending units for leased vehicles; and


  1. Requirements which are the responsibility of individual spending units rather than the Travel Management Office (making inquiries of DMV as to driving records, retiring vehicles to surplus, activity logs, discipline, etc.) are removed from throughout the rule, as is outdated and nonutilized language.



SUGGESTED COMMITTEE AMENDMENT:
An amendment is suggested which would clarify provisions of § 10.3 regarding terms and rates of leases and § 10.10 regarding the regular invoicing of costs of vehicles leases.
